TERMS & CONDITIONS
This Terms & Conditions (hereinafter the “T&C”) governs Pumpa Application (hereinafter the “Application”). The Application is operated by YaClass Tech Private Limited, incorporated in Chennai, India, reg. U80302TN2019PTC132261 (hereinafter the “Company”).
Please read this T&C carefully before using Application. By providing your consent you agree to the T&C. If you do not agree to the rules, please don’t provide consent and don’t use the Application. GENERAL PROVISIONS
You can use Application and other services rendered by the Company only for your personal and non-commercial use, any other usage than for personal purposes is prohibited.
You can download, install and use Application free of charge. Upon our sole discretion the Company may place advertisements and offer you chargeable products or services. Company has rights to change this T&C, including setting price, but we don’t charge any payments without obtaining your consent.
We may notify you upon changes in the T&C, security updates and other new features of the Application.
LIABILITY OF THE COMPANY
Internet connection is required for proper Application functioning. You acknowledge that Your ability to use Application is dependent upon Internet network availability and the Company cannot guarantee accessibility to the Application at all times. The Company is not liable for any Internet service provider fees that may be charged by the user’s operator depending on connection.
The Сompany is not responsible for errors, malfunctions or incompatibilities with individual devices or installed software. This Application is under development and planned to be constantly updated. Application can be used “as is” with all faults and without any warranty of any kind. The Company disclaims all warranties.
In no event shall the Company, its officers, directors, employees, partners, agents or related persons be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits or any other claim arising out, of or in connection with, your use of, or access to, the Application.
The Company is not liable for third party actions (including illegal actions), user actions and any consequences due to making user profile/tests results publicly available.
USER LIABILITY
User is responsible for keeping password protected, administrating profile settings. Application usage for children is allowed if parent consent is received according to applicable law. Financial transactions (if applicable) under the age of 18 restricted without parent or official representative consent.
Users are liable for compliance with the law, non-violating copyrights, Company and other individuals’ rights. In case if any violation is detected, user access may be restricted immediately.
This T&C is governed by Indian Republic laws.
COPYRIGHTS
Application or its parts such as software, design, content, trademarks, educational materials, text, images, video, scripts, audio and any other objects (hereinafter the “IP Assets”) contained in the Application are property of the Company (Company owns it or rights to use IP Assets legally obtained by the Company). All copyrights and intellectual property rights for IP Assets are protected by the Company.
Users are allowed to install Application to its device and use it as is. For any other usage you need to receive written consent of the Company. It is strictly prohibited to copy, download, reproduce, modify, republish, upload, retransmit, rearrange, distribute, translate, adapt or otherwise transform IP Assets without written consent of the Company.
Any decompilation, reverse engineering or disassembling of the Application is prohibited.
USER CONSENT
By providing your consent you expressly and totally agree to provide personal data to the Company as set forth in this T&C.
